Terms and Conditions of Location-Based Services

Human Consulting Group Co., Ltd. (hereinafter "HCG") establishes the following rights, obligations, responsibilities, and other necessary matters regarding location-based services between the company and individuals using location information.
Effective Date: June 06, 2024

Article 1 (Purpose)
These terms and conditions aim to regulate the rights, obligations, responsibilities, and other necessary matters between the company and individuals using location information related to the location-based services provided by the company.
Article 2. (Effectiveness and Changes to Terms of Use)
① These terms and conditions become effective when a customer or an individual using location information agrees to these terms and registers as a user of the service according to the procedures set by the company. If the user clicks the ‘Agree’ button online, it is considered that they have fully read, understood, and agreed to the application of these terms.
② The company may amend these terms within the bounds of relevant laws such as the Act on the Protection and Use of Location Information, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Basic Telecommunications Act, the Telecommunications Business Act, the Framework Act on Consumers, and the Act on the Regulation of Terms and Conditions.
③ When the company amends the terms, it will specify and announce the existing terms, amended terms, the effective date of the amendments, and the reasons for the amendments on the service website or notify the user electronically (via email, SMS, etc.) from 10 days before the effective date until a reasonable period after the effective date. If the amendments are unfavorable to the user, the notification will be made from 30 days before the effective date until a reasonable period after the effective date.
④ If the user does not express refusal by the effective date of the amended terms after being notified according to the above, it will be deemed that the user has approved the changes. If the user does not agree to the amended terms, they may terminate the service contract.
Article 3. (Supplementary Provisions)
① Matters not specified in these terms and conditions are governed by relevant laws such as the Act on the Protection and Use of Location Information, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Basic Telecommunications Act, the Telecommunications Business Act, and the company's terms of use and privacy policy, as well as separate guidelines set by the company.
Article 4. (Contents of Services)
① The company provides location-based services using the location information of the user provided by the location information provider, and the purpose and retention period of personal location information for service provision are as follows:

Article 5. (Service Fees)
① The location-based services in Article 4, Paragraph 1 are free of charge.
Article 6. (Service Target)
① These location-based services are provided only to corporations that have signed a service contract with the company.
Article 7. (Service Addition/Change)
① If the company needs to add or change the services provided to the location-based service provider, it will reflect the content in Article 4 and post and notify it according to Article 2, Paragraphs 4 and 5.
Article 8. (Use or Provision of Personal Location Information)
① The company notifies and obtains consent from the user to provide location-based services using personal location information.
② The company does not provide personal location information to third parties without the user's consent. If it provides personal location information to third parties, it notifies the user in advance and obtains consent.
③ When providing personal location information to a third party designated by the user, the location information provider automatically records and preserves the verification data of the use/provision of personal location information, and the data is retained for six months.
④ In the following cases, the notification is sent to the communication terminal device or email address specified by the user:
  1. 1. If the communication terminal device that collected personal location information does not have the function to receive text, voice, or video.
  2. 2. If the user requests notification to another communication terminal device or email address specified in advance
⑤ Based on Article 16, Paragraph 2 of the Act on the Protection and Use of Location Information, the company automatically records and retains verification data on the use and provision of personal location information, and such data is retained for six months.
Article 9. (Retention and Purpose of Personal Location Information)
HCG processes personal information as follows to provide location-based services.
  1. ① Personal location information is destroyed without delay when the purpose of use and provision as stated in Article 4 is achieved.
  2. ② HCG does not provide personal location information to third parties without the consent of the contracted customer. When providing to third parties, HCG notifies the recipient and purpose in advance and obtains consent.
Article 10. (Rights of Individuals Using Location Information and Methods of Exercise)
① Users can reserve all or part of their consent for the use and provision of personal location information at any time.
② Users can withdraw all or part of their consent for the use and provision of personal location information at any time. In this case, the company destroys the personal location information and verification data of the use/provision of location information within the withdrawn range without delay.
③ Users can request temporary suspension of the use and provision of personal location information, and the company cannot refuse and must prepare technical means to fulfill this.
④ Users can request access or notification of the following data and request corrections if there are errors. The company cannot refuse without justifiable reasons:
  • 1. Verification data of the use/provision of location information for the user
  • 2. Reasons and content of providing the user's personal location information to a third party under the Act on the Protection and Use of Location Information or other laws Users can request the exercise of their rights using the contact information in Articles 12 or 15 of these terms and conditions.
Article 11. (Application Exceptions)
The company does not collect personal location information from children under the age of 14.
Article 12. (Designation of Location Information Manager)
① The company designates a person who can take actual responsibility for properly managing and protecting location information and smoothly handling complaints from individuals using location information.

② The location information manager is the head of the department providing the location-based services, and specific details are specified in the supplementary provisions of these terms and conditions.
Article 13. (Compensation for Damages)
① Individuals using location information can claim compensation from the company if they suffer damages due to violations of Articles 15 to 26 of the Act on the Protection and Use of Location Information. In this case, the company is not liable if it proves no intention or negligence.
Article 14. (Dispute Resolution and Others)
① If a dispute related to location information arises and an agreement cannot be reached, the company or individual using location information can apply for mediation to the Korea Communications Commission.
② If a dispute related to location information arises and an agreement cannot be reached, the company or individual using location information can apply for dispute mediation through the Personal Information Portal in accordance with Article 43 of the Personal Information Protection Act.

Article 16. (Changes to the Terms and Conditions of Location-Based Services)
① This Terms and Conditions of Location-Based Services were revised on May 23, 2024, and will be notified at least 7 days in advance on the website in case of any additions, deletions, or modifications due to changes in government policies or security technologies.
